Melbourne Human Claw Waiver Form

1. Acknowledgment of Risk

The Participant’s Guardian acknowledges and understands that
the use of “The Human Claw” machine (the “Activity”) involves inherent risks,
including, but not limited to:

 

   •   Physical injury (e.g.,bruises, sprains, fractures).

   •   Emotional distress or discomfort.

   •   Equipment malfunction or misuse.

While the Business takes reasonable steps to ensure the safety and proper maintenance of its equipment, accidents and injuries may still occur.

2. Voluntary Participation

The Participant’s Guardian confirms that the Participant’s use of “The Human Claw” is voluntary. The Guardian agrees that they have evaluated the risks associated with the Activity and have chosen to allow the Participant to engage in it despite those risks.

3. Health and Physical Condition

The Participant’s Guardian represents that the Participant:

   •   Is in good physical and mental health.

   •   Has no medical conditions that would make participation unsafe.

   •   Will comply with all instructions provided by the Business’s staff during the Activity.

 

4. Assumption of Risk

The Participant’s Guardian expressly assumes all risks associated with the Participant’s use of “The Human Claw,” whether known or unknown, foreseeable or unforeseeable, and accepts full responsibility for any injury, loss, or damage arising from participation.

5. Waiver and Release

To the fullest extent permitted by law, the Participant’s Guardian, on behalf of the Participant, their heirs, executors, administrators, and assigns, releases and discharges the Business from any and all claims, demands, or causes of action arising out of or related to the Participant’s use of “The Human Claw,” including but not limited to those arising from negligence or other fault.

6. Indemnification

The Participant’s Guardian agrees to indemnify, defend, and hold harmless the Business from any claims brought against it arising out of the Participant’s use of the equipment, including legal fees and costs incurred in defending such claims.

7. Governing Law

This Waiver shall be governed by the laws of the State of Queensland.
Any disputes arising under this Waiver shall be resolved in the courts of Queensland.

8. Severability

If any part of this Waiver is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.
